Creigh Between A POTUS And A Union

Not much comment today. But I do want to point out an ironic note in the National News section: It looks like the NEA is a bit peeved at the Barack Obama for his charter school stand — believe it or not, he’s for them! That has Virginia implications as well. Will Creigh Deeds buck the POTUS or the VEA? Either way, that’s gotta hurt. Ouch! I feel his pain from here. In Commentary, Star Parker — thank you! — Finally! — someone has framed the central issue in all of these socialist schemes: It’s not increased taxes, as bad as that is, it’s not government inefficiencies, as incompetent as government is. It’s about our freedoms and liberty!

Believe What Liberals Say — About You!

As often commented upon here, it is amazing that liberals say things on the record, yet no one takes them seriously. But they mean every word of it! I know, I know . . . it’s so outlandish, that it’s hard to believe them or take their comments seriously. (Then read Barack Obama’s autobiography, where he admits that in college he purposely sought out as friends ”Marxist students and professors.” No doubt now we know he was, and is, serious about “transforming America,” eh?) But they mean what they say and aim to carry out their goals. One way to accomplish those goals, of course, is to demonize the people who disagree with them. Earlier, I posted a remarkable video of retired Marine David Hedrick hammering out the truth to his Representative, liberal Democrat Brian Baird of Washington state. Below is the video that probably had Mr. Hedrick disgusted at Representative Baird to begin with.

Don’t think he didn’t mean it. Liberal Congressman Brian Baird thinks nothing of insulting his constituents on national television.

Lisa Miller Rally Tomorrow In Winchester

Unlike the victory reported in the previous post, the decision in the Lisa Miller case, involving the custody of her daughter Isabella, is quite different. Tomorrow, Lisa will again be in court in Winchester, where a judge will decide whether she will be held in contempt, and perhaps even jailed, for not sending Isabella to Vermont on court-ordered visitations to her former lesbian partner.

Concerned Women For America Virginia will host a Protect Isabella Coalition Rally at 9:30 a.m., tomorrow, in front of the Winchester Judicial Center at 5 N. Kent Street, to show support for Lisa. For more information, contact CWA state director Janet Robey at janetrobey@yahoo.com.

Court Of Appeals Decides Custody Case Based On Marriage Amendment!

Early last week, the Court of Appeals of Virginia rendered a decision in a custody case and used the Marriage Amendment as a key element in their decision. (Damon v. York, see opinion here).

The case should sound familiar. Two women, one of whom had a child from a previous heterosexual marriage, lived together in Virginia. They then “briefly traveled” to Canada and were “married” under a Canadian law authorizing same-sex marriage. Eventually, there are accusations of child neglect and investigations by the Department of Social Services. The child involved was placed in the shared custody of the natural father and maternal grandmother. The “marriage” quickly dissolves, and a battle over visitation ensues.

Evidence was presented to the Virginia Beach Juvenile and Domestic Relations Court and visitation was denied to the former girlfriend of the biological mother. She appealed, and the case was accepted by the Court of Appeals.

In its decision, the court agreed with the lower court, arguing essentially that the former girlfriend had no “legitimate interest” in receiving custody. In addition to other legal reasons, the court decided that because the Canadian “marriage” was “void in all aspects” under Virginia law, it could not grant any visitation. It cited the Marriage Amendment to the Virginia Constitution, ratified by voters in 2006, and the Marriage Affirmation Act, passed by the General Assembly in 2004, as the binding law.

Of course, almost nothing of this case was reported in the Mainstream Media. It is very interesting that the media has no time to report the standing of the Marriage Amendment when it is upheld as binding law in a case. Yet, as in the case of Lisa Miller and her little girl Isabella, it is mentioned in every newspaper despite its absence in the courts’ decisions.   

In this latest custody battle, the Court of Appeals pointed out that “the interest of parents in the care, custody and control of their children — is perhaps the oldest fundamental liberty interests recognized by the Court.” Unfortunately, in a nation where words like “parents” and “family” and “marriage” are redefined, such legal standards are undermined every day. For example, the plaintiff seeking visitation used contrived phrases, such as “quasi-stepparent” and ”functional equivalent of a family member” to try to force herself into custody where she had no legal standing. With such nonsense, it’s amazing the case got this far up the legal ladder. Fortunately, the court got the decision right.

This Speaks For Itself

There are probably thousands of remarkable videos on YouTube and elsewhere from town hall meetings around the country with Americans of all types standing up for the founding principles of this country, or at least for some practical commonsense. We can’t keep up.

However, when we become aware of a particularly noteworthy video, we like to share it. Likewise, because the socialized medicine debate is moving at a speed unlike anything in this country’s history, it is almost impossible to keep up with all the moronic quotes on video and in print, such as the accusations from House Speaker Nancy Pelosi and other hyper liberals that the everyday Americans attending the town hall meetings are “Nazis,” “mobsters” and the like, especially when it’s there union allies and others who are causing physical violence. 

That’s what makes this particular gentleman, David Hedrick, particularly special and eloquent. His two minute comment to Representative Brian Baird (D-Washington) refutes so much of the demgoguery from the left, exposes them for who they are, eloquently states the truth and gives voice to millions of Americans. This video speaks for itself.
