The most liberal federal appellate court in the country, San Francisco-based Ninth Circuit Court of Appeals, ruled yesterday — reversing itself — that the words “Under God” in the Pledge of Allegiance and “In God We Trust” on U.S. currency are constitutional (Doug Stanglin on USA Today’s OnDeadline Blog). For those who can’t get a grip on the fact that mentions of “God” are not an establishment of religion, but that, in fact, our Founders based our laws and constitutional government on a reliance of God, here is what Judge Carlos Bea wrote in his opinion (Google/AP):

The Pledge of Allegiance serves to unite our vast nation through the proud recitation of some of the ideals upon which our Republic was founded.

Regarding the currency, the court ruled . . .

the phrase is ceremonial and patriotic and “has nothing whatsover to do with the establishment of religion.”

If the Ninth Circuit gets it, then why can’t secular progressives, Atheists and extreme leftists of various (and nefarious) stripes get it? It’s time for them to find a new game to play.

As mentioned here (and according to the AP), 13 attorneys general are preparing to file suit on behalf of their states to block any eventual nationalization of America’s health care system — or at least leave their states free to choose whether to participate. Virginia Attorney General Bill Mims is one of the 13.

Law suits have been known to work. It is, after all, the states which have the right and obligation to defend themselves from participation in any federal scheme not enumerated in the constitution as a federal responsibility — also known as the 10th Amendment. Of course, the 10th Amendment, nor anything about the constitution, has stopped the federales from increasing its size and scope over our lives throughout recent decades.

But law suits aside, what else can the states do? Apart from the attorney general, who else is in the game? What about legislatures? If Delegate Bob Marshall (R-13, Prince William) has anything to do with it, Virginia’s General Assembly will have a lot to do with it. Last month, he made a presentation to the Tuesday Morning Group Coalition about HB 10, The Health Care Freedom Act, a bill he has already filed. Other patrons thus far are John O’Bannon (R-73, Henrico), Scott Lingamfelter (R-31, Prince William), Harvey Morgan (R-98, Gloucester) and Bob Tata (R-85, Virginia Beach). HB 10 reads, in its entirety, thus:

No law shall restrict a person’s natural right and power of contract to secure the blessings of liberty to choose private health care systems or private plans. No law shall interfere with the right of a person or entity to pay for lawful medical services to preserve life or health, nor shall any law impose a penalty, tax, fee, or fine, of any type, to decline or to contract for health care coverage or to participate in any particular health care system or plan, except as required by a court where an individual or entity is a named party in a judicial dispute. Nothing herein shall be construed to expand, limit or otherwise modify any determination of law regarding what constitutes lawful medical services within the Commonwealth.

Marshall, as ever, is sure of its legislative cure as well as its constitutionality, as we are reminded by Norm Leahy at Tertium Quids. In fact, as Leahy points out, Delegate Marshall offers a Q&A on Dr. Bob Hollsworth’s Virginia Tomorrow blog, asking and answering questions himself, a FAQ tutorial on state legislative prerogative on federal issues, if you will. At least as far as it concerns the federal takeover of the health care industry and individuals’ constitutional rights to be forced into it. 

So, the 10th Amendment lives? We’ll see what Virginia’s General Assembly says — about its own authority. Virginia could make hay as the bulwark against the largest federal power grab in history. That would really give the lawyers something to fight about.

Will Dave Marsden’s Quick Move Move Him To The Senate Or Backfire?

News in the two Virginia Senate special elections is heating up. In the 37th district, which is open due to the election of Attorney General-elect Ken Cuccinelli, Democrat Delegate Dave Marsden is being pressured to resign his House seat now that he is officially campaigning for the Senate. The reason: If elected, he will leave the 41 district delegate-less in the House for a good portion of the 2010 General Assembly while yet another special election is called. Marsden refuses, but there is another twist: Marsden doesn’t live in the Senate district, so he is taking a room in the home of a supporter who lives in an overlapping  precinct. It gives new meaning to carpetbagging. It may solve (cheesily) the technical residency requirement, but it’s brazenness may alienate voters.

In Commentary, Thomas D. Segel looks at a doctor shortage that will get worse under Obamacare, Star Parker writes about D.C.’s new homosexual friendly city council, and Henry Lamb weighs in on property rights. The Slow Time

It’s a slow political news cycle this time of year, especially right after a gangbusters election, as things settle down. Soon, however, it will be special election time in Fairfax and Virginia Beach for two Virginia Senate seats (vacated by the elections of Ken Cuccinelli to attorney general and Ken Stolle to Virginia Beach Sheriff). It’s becoming more likely that the new senator from Virginia Beach will be the Republican nominee since the Democrats can’t seem to find a candidate. Bob McDonnell will show his bipartisan stripes and meet with House Democrats, while Ron Villanueva gains another vote in his bid to keep said Dems one seat fewer.

In Transition

Not missing a beat, Governor-elect Bob McDonnell has gone into transition mode and all seems hunky-dory — Governor Tim Kaine has pledged to cue him in on the budget and give him “some breathing room” on the needed cuts so his successor won’t have to make many crucial decisions so soon. It’s a quirk in Virginia’s budget cycle that the outgoing governor submits the new two-year budget. The new guv has to deal with it. Changing that, and perhaps moving the legislative session to start in February to give the new guy some “breathing room” might be  good places to start for the reform minded in the General Assembly and the new administration.

So, as you can guess, it’s mostly transition news today, but we also have comment from McDonnell’s campaign chairman, Ed Gillespie, in the Washington Post, wherein he relates lessons learned. Meanwhile, the AP offers analysis on who did not vote and why not. In National News, homosexual groups are steamed at . . . Barack Obama . . . for its huge setback and humbling loss in liberal Maine’s marriage amendment referendum. (What’s the record now? 0-32? Another month, another campaign draws toward conclusion. Where does the time go? Where does life go? A sign of the times: Campaign news is light today. Everyone is expecting an anti-climatic GOP blowout. But will it be? What about New Jersey and the special Congressional election in upstate New York? If the Dems pull those out will that blunt any GOP resurgence nationally otherwise gained from a Virginia sweep? If the numbers hold, how many Republican delegates will win? Retirements alone guarantee a large freshman class in January.

About today’s headlines: The Richmond Times-Dispatch gets up close and personal with the LG candidates and the Washington Times already is analyzing where Creigh Deeds went wrong. Why is it always where Creigh Deeds went wrong? Bob McDonnell, Bill Bolling and Ken Cuccinelli have done a lot right. Meanwhile, political soothsayer Dr. Larry Sabato offers his predictions on the election.

Nationally: It’s unfortunate that several pastors in Washington, D.C., are supporting homosexual “marriage” there; the AP reports that, indeed, abortion funding is in the health care “reform” bill; and sociologist Brad Wilcox of U.Va., and The Family Foundation Marriage Commission, caught the AP’s attention with his research that faith helps marriages!

In Commentary, Dr. Thomas Sowell offers part two of his “Dismantling of America” exposition, the first part of which we posted earlier this week, and which drew considerable praise from Rush Limbaugh, among others. Also, a skin care company is using fetal cells in its product; Tim Kaine’s DNC has selected as a finalist in a contest promoting the health care bill a video that desecrates the American flag; and a high ranking Obama administration official reveals her “ultimate expression of self-righteous victimhood.” This is the weekend we move our clocks back and it gets dark earlier. How appropriate.

After yesterday’s super-sized edition, much of today’s news is of the national variety, including some spot-on commentary. Among the most eye-catching articles are one in which the Census Bureau reports on the change in lifestyle brought on by the recession, including the delay of marriage; a Muslim girl who ran away from her parents because she converted to Christianity will have her day in court; and Florida school officials are cleared in a case brought by the ACLU over a meal blessing.

Elsewhere, the AP comes out with its second fact check in two weeks disputing claims coming directly from President Obama’s golden tongue (see first one here). Yes, Mr. President, your “reform” is a giant tax increase, even if you can get David Letterman to believe otherwise. The AP better watch itself if it keeps reporting the truth. Thomas Sowell writes about facing advantages and disadvantages in life by recounting his own upbringing. Truly inspirational and a must read.

Setting Trends

The News Stand is back after a bit of a late summer break. After all, nothing happens this time of year, anyway, right? So, we’re getting right back into it with a pretty large News Stand. Leading off is an interesting bit of news breaking about the Democrat gubernatorial candidate, Senator Creigh Deeds. Seems back in the day, oh, about 10 years ago, he wrote some of his own thoughts on homosexuals. Uncovered by The Weekly Standard and reported by our friends at Bearing Drift.

But that’s not all. Senator “Not Going To Run A Divisive Campaign” seems to have some out-of-control staff in Hampton Roads. Bearing Drift, again, with the details. Is this negativity a trend?

In fact, we have been e-mailed some pictures of dirty tricks in Buena Vista during the Labor Day Parade and we hope to have them up today.

Bearing Drift also has an update on several House races — let’s not forget the House campaign — with a report on a negative mailer (yes, a trend) and interesting polling numbers on a seat held by a liberal Democrat in a district the GOP carries in statewide races, but which it has not been able to find traction on at the House level. Almost given up on, unexpectedly, it’s back in play. A GOP pickup there would be huge. At the least, the numbers might dictate a reallocation of campaign dollars by state Dems to protect an incumbent, which would hurt their chances in other targeted districts. (By the way, congrats to BD — it’s the first blog to lead off the News Stand.)

Oh, other than that? How about the budget cuts by the DNC Chairman, Governor Tim Kaine? Furloughs and layoffs for state employees and education cuts. Is this what the unions voted for four years ago?

Nationally, actress Patricia Mauceri claims she was fired from her long standing role because of her objection to her character becoming homosexual; the new civil rights movement, education choice, is drawing more attention in dramatic ways (as rights movements usually do); and the Obama administration’s health care “reform” numbers are torn apart by the AP. Commentary features the always great Walter Williams and a thought-provoking piece on self-hate by Lisa Fabrizio. Virginia’s own, Republican Whip Eric Cantor, makes the national headlines, again, with his rebuttal of the administration’s analysis of its “stimulus” program. He says it ain’t working. Speaking of money, the commonwealth is going to report more bad news tomorrow on revenue projections on which to fund the budget, which means more cuts are on the way by the DNC Chairman, Governor Tim Kaine.

As Chris wrote in the previous post, Democrat gubernatorial candidate Creigh Deeds has yet another position on abortion. First, it wasn’t going to be an issue. Then it became an issue for everyone. Now, it’s one only for the poor. See the analysis by J.R. Hoeft at BearingDrift.com.

There’s a lot else going on. Of course, health care, which is all consuming, it seems. But there’s a new angle — the White House invasion of your e-mail. Grades Are Good When Grading Yourself

In the queue today is the governor. According to the Norfolk Virginian-Pilot, he’s grading himself on handling the disastrous budget problems, kind of like how some candidates this past spring, during the nominating contests, issued news releases quoting themselves as winning debates. Brilliant.  But isn’t Governor Kaine grading himself on the budget something akin to a guy causing a car wreck taking credit for saving his victim’s life? Just asking.

Also re: the governor: The Washington Post’s look at his unique position during the campaign — “not on the ballot, but on the spot.” Clever word play, but no matter how you phrase it, at least as of now, the campaign is a referendum on Virginia and national Democrats who, again according to the Post, still are running against former President George W. Bush. I thought the Dems were the party of the future. Speaking of blame, the policy party also is trying to make something said by Virginia GOP Chairman Pat Mullins into something it’s not. Where have we heard something similar? Oh, yeah, yesterday.

In our Commentary section, liberal Richard Cohen decries the “hate crimes bill,” with very good sense. The always brilliant Thomas Sowell takes apart socialism and the equally brilliant Walter Williams explains liberty. For his part, David Limbaugh demonstrates that as much as Barack Obama is spending and printing money at our expense (and borrowed Chinese money, too), one thing he can’t afford is the truth on “health care reform” —and most Americans wouldn’t buy (if we had the money) what he’s selling anyway.
